Terms and Conditions of Service

These Terms and Conditions (“Terms”) govern all pest control and mosquito control services provided by Pest Hunters – Mosquito Hunters (“Company,” “we,” “us,” or “our”) to the customer (“Customer,” “you,” or “your”). By scheduling, authorizing, or receiving services, you agree to be bound by these Terms.

1. Scope of Services

Pest Hunters – Mosquito Hunters provides professional pest control, rodent control mosquito control, and other related services, including but not limited to inspection, treatment, prevention, and maintenance programs for residential and commercial properties.

Services are designed to reduce pest activity, not guarantee complete or permanent elimination. Pest populations are influenced by environmental conditions beyond our control, including weather, surrounding properties, sanitation, and structural factors.

2. Service Authorization

By scheduling service, the Customer authorizes Pest Hunters – Mosquito Hunters to:

• Perform pest, rodent, or mosquito treatments as requested
• Access designated areas of the property necessary to complete service
• Apply EPA-registered products according to label instructions and applicable laws

If the Customer is not present at the time of service, authorization is implied unless previously revoked in writing.

3. No Guarantee of Total Elimination

While we use industry-approved methods and products, no pest control service can guarantee 100% elimination. Reinfestation may occur due to factors such as:

• Weather conditions
• Neighboring properties
• Structural vulnerabilities
• Landscaping, standing water, or sanitation issues

Follow-up treatments may be required to maintain control.

4. Customer Responsibilities

The Customer agrees to:

• Provide accurate information regarding pest activity and property conditions
• Prepare the property as instructed prior to treatment
• Secure pets and notify us of any sensitive individuals (children, elderly, allergies, pregnancy, etc.)
• Maintain proper sanitation and environmental conditions after treatment

Failure to comply with preparation or maintenance instructions may reduce treatment effectiveness and void any service warranty.

5. Weather & Environmental Conditions

Mosquito and outdoor pest treatments are highly weather-dependent. Rain, wind, drought, excessive heat, or standing water can affect treatment results.

The Company reserves the right to:

• Delay or reschedule services due to unsafe or ineffective conditions
• Adjust treatment plans based on environmental factors

Weather-related interruptions do not constitute a breach of contract.

6. Chemicals & Safety

All products used by Pest Hunters – Mosquito Hunters are:

• EPA-approved and applied according to label instructions
• Selected based on effectiveness and safety standards

Customers acknowledge that pest control products may pose inherent risks if label directions are not followed. The Company is not responsible for adverse effects resulting from Customer failure to follow post-treatment instructions.

7. Service Plans & Recurring Programs

Recurring services (monthly, bi-monthly, seasonal, or annual) will continue automatically unless canceled in accordance with Section 10.

Service frequency may be adjusted based on pest pressure, weather conditions, or regulatory requirements.

8. Payment Terms

• Payment is due at the time of service unless otherwise agreed in writing
• Accepted payment methods include [list methods]
• Late or declined payments may result in service suspension

The Company reserves the right to charge late fees, collection costs, or interest as permitted by law.

9. Warranties & Limitations

Any service warranty is limited to re-treatment only and does not include refunds unless explicitly stated in writing.

No warranty applies if:

• The Customer alters treated areas
• Recommended repairs or sanitation steps are ignored
• Additional pest-attracting conditions are introduced

10. Cancellation & Termination

• One-time services may be canceled with at least 24 hours’ notice
• Recurring services require 2 days’ written notice to cancel
• Missed or late cancellations may result in a cancellation fee

The Company may terminate service at any time due to unsafe conditions, non-payment, or Customer misconduct.

11. Limitation of Liability

To the fullest extent permitted by law, Pest Hunters – Mosquito Hunters shall not be liable for:

• Indirect, incidental, or consequential damages
• Property damage not directly caused by gross negligence
• Health issues resulting from failure to follow safety instructions

Total liability shall not exceed the amount paid for the most recent service.

12. Indemnification

The Customer agrees to indemnify and hold harmless Pest Hunters – Mosquito Hunters from claims arising out of:

• Customer negligence
• Failure to disclose relevant property or health information
• Misuse of treated areas contrary to instructions

13. Compliance With Laws

All services are performed in compliance with:

• Federal, state, and local pesticide regulations
• EPA labeling requirements
• State licensing and applicator standards

14. Dispute Resolution

Any dispute arising from these Terms shall be governed by the laws of the state of Florida. The parties agree to attempt good-faith resolution before pursuing litigation.

15. Modifications

The Company reserves the right to update these Terms at any time. Continued use of services after changes constitutes acceptance of the revised Terms.

16. Entire Agreement

These Terms constitute the entire agreement between the Customer and Pest Hunters – Mosquito Hunters and supersede any prior verbal or written agreements.
